Such modifications shall be effective immediately. Accordingly, please continue to review these Terms of Use whenever accessing or using the Campus Home Exchange website (“the Site”). If you do not agree with all of the Terms of Use, you may not access or use any part of this service.

Code of Conduct
By accessing and using this site or any part of this service, you agree that:

Site Content

• The information you post to the Site will be accurate and provide a true representation of you and your home(s). Omission of relevant information is considered providing false representation. You understand that Campus Home Exchange is not responsible for the accuracy of the information posted by members.
• You will maintain current personal and listing information on the Site.

Site Use

• You will use the Site only for the purpose for which it is intended, which is connecting with other members with the intent to exchange or rent a home.
• You will be courteous and respectful in all your communications and interactions with members.

Exchange

• You will honor your mutually agreed upon commitments to the fullest extent possible.
• You will prepare your home to be in clean and good working order for your guests’ arrival.
• You will endeavor to help your guest feel welcome and comfortable in your home.
• You will treat your exchange partners’ homes with the utmost respect and leave them as you found them upon arrival.
• You will be responsible for determining whether there are any local ordinances or regulations or other permit requirements applicable to the exchange or rental of your house.

Content & Use of the Site
By posting or submitting material to the Site you represent that you have all necessary rights in and to such material; that such material will not infringe on any personal or proprietary rights of any third parties; that such material will not contain defamatory, indecent, threatening, or otherwise unlawful content; and that such material will not contain any viruses or other destructive features. You authorize Campus Home Exchange to use such material in any manner or medium in keeping with the Privacy Policy.

You may not advertise or solicit on these pages without Campus Home Exchange’s express permission. Campus Home Exchange reserves the right to monitor any postings and remove any which it considers, in its discretion, to be offensive or otherwise in breach of these Terms of Use.

You agree to refrain from mining member data for use other than the intent to make exchange or rental arrangements regarding your home that is listed on the Site. Members may not use any content from the Site for any solicitations, or for any commercial use.

Rights to Cease Service
You may terminate service at any time by deleting listing information. There will be no refund of subscription fees.

Campus Home Exchange reserves the right, which it may or may not exercise, to review, edit, or delete any material that it deems to be inappropriate or in violation of these Terms of Use and to deny access and / or cease service to anyone who violates these Terms of Use.

 

Disclaimer & Limitation of Liability
You agree that the role of Campus Home Exchange is to publish home listings of its members and to facilitate contact between its members. Campus Home Exchange is not responsible or liable for any arrangements and / or agreements and results of said arrangements and agreements made between any parties using the Site. Any disputes relating to the exchange or rental transaction must be resolved by the parties to the transaction.

You agree that your use of the Site shall be at your sole risk. The operation of the Site and the information available thereon are provided “as is”. To the full extent permitted by law, Campus Home Exchange and its Officers, Directors, Employees, and Agents disclaim all warranties, express or implied, in connection with the Site and your use thereof. Campus Home Exchange makes no warranties or representations about the accuracy or completeness of the Site’s content or the content of any websites linked to the Site and assumes no liability or responsibility for any (1) Errors, omissions, mistakes or inaccuracies of content, (2) loss or damage of any kind, including but not limited to personal or property, incurred as a result of the use of any information posted, emailed, transmitted, or otherwise available via the Site, (3) unauthorized access to or use of our secure servers and / or any and all personal information stored therein, (4) interruption or cessation of transmission to or from the Site, and / or (5) bugs, viruses, Trojan horses or the like which may be transmitted to or through the Site by any third party.

No warranty of any kind, implied, expressed or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose and freedom from computer virus, is given with respect to the contents of the Site or its hyperlinks to other Internet resources.

In no event shall Campus Home Exchange, its Officers, Directors, Employees, or Agents be liable for any direct, indirect, incidental, special, punitive or consequential damages whatsoever arising under or as a result of these Terms of Use, the use or inability to use the Site or the contents of the Site, whether based on warranty, contract, tort, or any other legal theory, and whether or not Campus Home Exchange is advised of the possibility of such damages and this limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

Indemnification
You agree to indemnify and hold harmless Campus Home Exchange and Officers, Directors, Employees, or Agents from any injury or damage suffered directly or indirectly as a result of your use of the Site, including but not limited to (1) any claims for injury or damage to person or property arising from a property you own; (2) any claims of injury or damage to person or property arising from a property transaction to which you are a party; (3) a violation of the Terms of Use by you or anyone using your computer or your membership account; (4) a claim that any use of the Site by you or someone using your computer or your membership account infringes any property right of any third party; (5) any misrepresentation by you; or (6) any breach of any agreement to be performed by you. You agree to pay any and all costs, damages and expenses, including, but not limited to, reasonable attorneys’ fees and costs awarded against or otherwise incurred by or in connection with or arising from any such claim, suit, action or proceeding attributable to any such claim.

Right to Assign
Campus Home Exchange may assign its rights to this Agreement without the members' consent. If Campus Home Exchange assigns its rights, is sold to another entity, or enters into an agreement with another company, Campus Home Exchange or its successor will give notice to members who may opt out by terminating membership.

Legal Action & Enforcement of this Agreement
If a dispute arises between you and Campus Home Exchange, any legal action will be brought exclusively in the courts of Massachusetts, United States of America, which shall have exclusive jurisdiction and shall apply the laws of Massachusetts without regard to any other choice of law considerations. If legal action is required to enforce any provision of this Agreement, the prevailing party shall be entitled to its reasonable attorney fees.

Entire Agreement
These Terms of Use constitute the entire agreement between you and Campus Home Exchange. If any provision of these Terms of Use is found invalid or unenforceable, that provision will be enforced to the maximum extent possible, and the other provisions shall remain in force. Campus Home Exchange reserves the right to add, remove or amend these Terms of Use at any time without notice. Such modifications shall be effective immediately.
